1Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Goastral ("we", "us", "our") governing your use of the SPOTR mobile application and any related services (collectively, the "Service").

By creating an account or using SPOTR, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2Eligibility

• You must be at least 13 years old to use SPOTR.
• If you are between 13 and 18 years old, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• You must have a valid Google account to register.
• You may only maintain one SPOTR account.
• If we have previously terminated your account for violations of these Terms, you may not register again without our written permission.

3Your Account

3.1 Account Security

You are responsible for maintaining the security of your Google account used to sign in to SPOTR. Notify us immediately at 1.suyashk@gmail.com if you suspect unauthorised access.

3.2 Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.

3.3 Username

Your username must not impersonate another person, be offensive, or include reserved terms (such as "admin", "spotr", or "official"). We reserve the right to reclaim or change usernames that violate these rules.

4User-Generated Content

4.1 Your Content

"Content" means any text, photos, locations, or other material you submit through SPOTR, including spots, profile photos, usernames, and descriptions.

4.3 Licence You Grant Us

By submitting Content to SPOTR, you grant Goastral a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to host, store, display, reproduce, and distribute that Content solely for the purpose of operating and improving the Service. You retain ownership of your Content.

4.4 Content You Are Responsible For

You are solely responsible for the Content you post. You represent and warrant that:

• You own or have the right to use and share the Content.
• The Content does not violate any applicable law or third-party rights.
• The Content is accurate to the best of your knowledge (for spots that claim to report real-world events or conditions).

4.5 Content Removal

We reserve the right to remove any Content that violates these Terms or our content guidelines, at our sole discretion and without notice.

5Prohibited Conduct

You agree not to use SPOTR to:

• Post false, misleading, or fraudulent information (e.g. fake hazards or non-existent events)
• Harass, threaten, bully, or harm other users
• Post content that is unlawful, obscene, defamatory, or sexually explicit
• Share content that infringes intellectual property rights of others
• Collect or harvest personal information about other users without their consent
• Use the Service to send spam, unsolicited messages, or advertisements
• Attempt to gain unauthorised access to the Service, other accounts, or our systems
• Use automated bots, scrapers, or scripts to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Violate any applicable local, national, or international law or regulation
• Use the Service in any way that could damage, disable, or impair the Service or servers

6Location Data

SPOTR uses your device's precise GPS location to function. By granting location permission you consent to:

• Your real-time location being used to fetch nearby spots from our servers (while the app is open)
• Your GPS coordinates being permanently stored and publicly attached to any spots you create

You can revoke location permission in your device settings at any time, but core functionality will not be available without it.

7Navigation and Physical Safety

SPOTR provides a "Get Directions" feature that opens a third-party maps application to navigate to a spot's location. By using this feature you acknowledge and agree that:

• Spots are posted by community members and SPOTR does not verify their accuracy, legitimacy, or safety.
• You are solely responsible for your decision to travel to any location identified through SPOTR.
• SPOTR is not liable for any injury, loss, damage, or harm — physical, financial, or otherwise — that occurs as a result of you travelling to or visiting a location shown in the app.
• Navigation is provided via third-party mapping services (such as Google Maps) that have their own terms and privacy policies. SPOTR has no control over and accepts no responsibility for third-party navigation accuracy or availability.
• You must always exercise your own independent judgement before acting on information posted by other users.

8Intellectual Property

8.1 Our Property

The SPOTR app, including its name, logo, design, code, and all non-user content, is owned by Goastral and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.

8.2 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.

9Privacy

Your use of SPOTR is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

10Third-Party Services

SPOTR integrates with third-party services including Google (authentication) and Mapbox (maps). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

11Disclaimers

We do not guarantee that:

• The Service will be available at all times or free from errors
• Spots posted by users are accurate, safe, or reliable
• The Service will meet your specific requirements

User-generated spot content (events, hazards, offers) is posted by members of the public. Always use your own judgement. Do not rely solely on SPOTR for safety-critical decisions.

12Limitation of Liability

To the maximum extent permitted by applicable law, Goastral and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Service — including but not limited to:

• Loss of data, revenue, or profits
• Personal injury or property damage arising from reliance on user-posted content
• Unauthorised access to or alteration of your content

Our total liability to you for any claim arising from these Terms or the Service shall not exceed INR 1,000 (one thousand Indian Rupees), or the equivalent in your local currency.

13Indemnification

You agree to indemnify, defend, and hold harmless Goastral and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of any rights of another person.

14Termination

14.1 By You

You may delete your account at any time from within the app (Profile → Settings → Delete Account). Upon deletion, your data is permanently removed per our Privacy Policy.

14.2 By Us

We reserve the right to suspend or terminate your account immediately, without notice or liability, if you violate these Terms or if we determine, in our sole discretion, that your continued use is harmful to the Service or other users.

14.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) shall survive.

15Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of India.

16Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by updating the effective date and, where appropriate, via in-app notification. Your continued use of SPOTR after any change constitutes your acceptance of the updated Terms.
